📦 Terms of Service – Xinhan Logistics

These Terms of Service (“TOS”) constitute a legally binding agreement between you (“Client”, “Shipper”, “You”) and Xinhan Logistics (“Company”, “We”, “Us”). By submitting a booking request, quote inquiry, or utilizing our logistics services, you agree to comply with these terms.

1. Booking and Confirmation

  • Booking Request: A booking is not confirmed until you receive a written confirmation (Booking Note or Invoice) from Xinhan Logistics.
  • Accuracy: You are responsible for the accuracy of shipment details (weight, dimensions, commodity description). Any discrepancies may result in additional charges or delays.
  • Cut-off Times: All bookings must be received prior to carrier cut-off times. We are not liable for missed sailings due to late documentation.

2. Rates and Charges

  • Rate Validity: All quoted rates are valid for the period specified in the quotation. Rates are subject to change due to fluctuations in fuel surcharges (BAF/CAF), currency adjustment factors (CAF), or carrier rate increases.
  • Destination Charges: Unless explicitly stated as “Door-to-Door (DDP)”, the quoted price covers origin charges only. Destination terminal fees, customs duties, and delivery fees are the responsibility of the consignee or importer of record.

3. Packaging and Labeling

  • Secure Packaging: You are responsible for ensuring that goods are properly packaged to withstand international transit. This includes protection against humidity, shock, and compression.
  • Hazardous Materials: If shipping Dangerous Goods (DG), you must provide a Material Safety Data Sheet (MSDS) and proper DG packaging. Failure to declare hazardous materials is a criminal offense and voids our liability.

4. Customs Clearance and Compliance

  • Documentation: You must provide accurate commercial invoices, packing lists, and any required certificates (e.g., Certificate of Origin).
  • Import/Export Restrictions: You warrant that the goods are not prohibited by the origin or destination country. Xinhan Logistics reserves the right to refuse shipments involving restricted items (e.g., weapons, illegal drugs, certain electronics without certification).

5. Prohibited Commodities

Without prior written approval, the following items are strictly prohibited:

  • Live animals, human remains, currency, precious metals.
  • Flammable liquids/solids, explosives, and corrosives not properly declared.
  • Counterfeit goods or items infringing on intellectual property rights.

6. Cancellation and Amendment Policy

  • Cancellation: Cancellations made after container loading or airway bill issuance will incur a cancellation fee equivalent to the operational costs incurred.
  • Rollover: If a shipment is rolled over to the next sailing by the carrier, we will notify you immediately, but we are not liable for consequential damages arising from the delay.

7. Cargo Insurance

While we take utmost care in handling your goods, we strongly recommend purchasing All-Risk Cargo Insurance. Xinhan Logistics is not an insurer. Unless you have purchased insurance through us, claims for loss or damage will be subject to the limited liability of the carrier.

8. Force Majeure (不可抗力)

Xinhan Logistics shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to: acts of God, war, terrorism, riots, strikes, port congestion, government orders, or pandemics.

9. Governing Law

These Terms of Service shall be governed by the laws of the People’s Republic of China. Any disputes arising from the performance of these services shall be settled in the courts of Guangzhou, China.
